Terms and conditions<\/b><\/p>\n

  1. Scope<\/li>\n<\/ol>\n

    These general terms and conditions of use for the webinar (\u201cgeneral terms and conditions\u201d) set out the terms of use for the service and the content of the individual services and content offered (\u201cwebinar\u201d) by Top Life Project S.r.l.s. (hereinafter also referred to as the \u201cCompany<\/b>\u201d), with registered office at Piazza Mazzini 18, 39100 Bolzano (BZ), tax code and VAT number 03126040215, REA number BZ \u2013 234277, via the website https:\/\/www.toplifeproject.com and made available to individual users.<\/p>\n

    The Company is the owner of the website https:\/\/red-therapy.com and is responsible for the products, services and content made available to individual users.<\/p>\n

    1. Definitions<\/li>\n<\/ol>\n

      The term \u201cuser<\/b>\u201d refers to the natural or legal person who enters into a contract with the Company for the use of the products.<\/p>\n

      The term \u201cLamps<\/b>\u201d refers to the category of products relating to photobiomodulation<\/p>\n

      The term \u201cGlasses<\/b>\u201d refers to the category of products relating to blue-blocker glasses.<\/p>\n

      The term \u201cWebsite<\/b>\u201d refers to the site from which the user can purchase the products.<\/p>\n

      The term \u201cConsumer Code<\/b>\u201d refers to Legislative Decree No. 206 of 2005.<\/p>\n

      The term \u201cCopyright Act<\/b>\u201d refers to Act No. 633 of 1941.<\/p>\n

      1. Subject matter of the contract \u2013 commercial offer<\/li>\n<\/ol>\n

        The subject matter of the contract between the Company and the user is the supply of products for therapeutic and wellness purposes, in accordance with the commercial offer (price) published on the Website and in accordance with the general terms and conditions.<\/p>\n

        The price indicated on the Website is an integral and essential part of the general terms and conditions. Acceptance of the general terms and conditions implies automatic acceptance of the commercial offer.<\/p>\n

        1. Conclusion of the contract<\/li>\n<\/ol>\n

          For the contract to be validly concluded, the user must have legal capacity, i.e. must have reached the age of majority at the time of payment and must not be legally incapacitated or unable to enter into contracts.<\/p>\n

          The contract is concluded once payment has been made in accordance with the methods set out in point 6 of these general terms and conditions. By making the payment, the user declares that they have legal capacity.<\/p>\n

          The user will receive a confirmation email after payment.<\/p>\n

          A necessary condition for the conclusion of the contract is that, prior to making payment, the user registers for the course by completing the registration form with the required details and subsequently accepting these general terms and conditions and the privacy policy.<\/p>\n

          If the user does not agree with the general terms and conditions or the privacy policy, or does not wish to accept them, they must not proceed with the conclusion of the contract and should exit the Website.<\/p>\n

          1. Processing of the user\u2019s personal data<\/li>\n<\/ol>\n

            The user\u2019s personal data will be processed as described in the privacy policy provided to them upon registration or purchase of the webinar and available at this link.<\/p>\n

            1. Payment methods<\/li>\n<\/ol>\n

              The total price to be paid for the conclusion of the contract is shown to the user prior to payment.<\/p>\n

              By clicking on the \u201cPayment\u201d button, the user may choose between the following two payment methods:<\/p>\n

              Stripe: If the Stripe payment method is selected, the contract is concluded upon confirmation of the payment order to Stripe. Stripe is a payment service provider through which payments can be accepted via, for example, credit card, debit card, Google Pay or Apple Pay. You must be registered or register first, log in using your credentials and confirm the payment order. You will receive further instructions directly from Stripe during the payment process. No additional fees will be charged.<\/p>\n

              PayPal: If you choose the PayPal payment method, the contract is concluded upon confirmation of the payment order to PayPal. You must be registered or register first, log in with your credentials and confirm the payment order. You will receive further instructions directly from PayPal during the payment process. No additional fees will be charged.<\/p>\n

              Other payment methods are not accepted.<\/p>\n

              You are not entitled to make any further claims or seek damages from the Company.<\/p>\n

              Right of withdrawal<\/p>\n

              • If the user is a consumer, they have, pursuant to Article 52 of Legislative Decree No. 206 of 2005, a period of fourteen days to withdraw from the contract without having to provide any reason.<\/li>\n
              • To exercise the right of withdrawal, the user must notify the Company, by means of a written statement (e.g. letter, email to the contact details set out in point 1), of their decision to withdraw from the contract entered into before the expiry of the fourteen-day period.<\/li>\n
              • If the right of withdrawal has been correctly exercised, the Company shall refund the price paid immediately, and at the latest within fourteen days of receiving the notice of withdrawal.<\/li>\n<\/ul>\n

                Right of withdrawal<\/p>\n

                Consumer Users resident in Italy may exercise their right of withdrawal within 14 days of the date of purchase by sending a notice to the following email address: support@red-therapy.com.<\/p>\n

                In order to exercise the right of withdrawal, the relevant notice must be sent before the expiry of the 14-day period.<\/p>\n

                • Jurisdiction, applicable law and referral<\/li>\n<\/ul>\n

                  The exclusive place of jurisdiction for all disputes arising from the contract is Bolzano (Italy). Italian law applies. The mandatory provisions of the Consumer Code remain unaffected.<\/p>\n

                  In the event of a dispute arising between the Company and a consumer resident in the European Union regarding the contractual obligations arising from the contract concluded online, there is the possibility of out-of-court settlement of the dispute by contacting an ADR body included in a list pursuant to Article 20(2) of Directive 2013\/11\/EU and using the ODR platform. The European Commission provides an online platform for online dispute resolution (ODR) which can be found at https:\/\/ec.europa.eu\/consumers\/odr.<\/p>\n

                  Pursuant to Directive 2013\/11\/EU, transposed into national law by an amendment to the Consumer Code, the user-consumer also has the option of alternative dispute resolution with the Company. In this case, the consumer may contact the online conciliation office for consumer disputes arising from e-commerce contracts, \u201cConciliareonline.it\u201d, based at the Consumer Protection Centre (CTCU) \u2013 Conciliareonline.it, Via Dodiciville, 2, I-39100 Bolzano (Italy), tel. +39 0471\/975597, fax +39 0471\/979914, email: info@conciliareonline.it \/ info@onlineschlichter.it. The website and instructions for conciliation are accessible via the link conciliareonline.it.<\/p>\n
